The “Terms and Conditions”, “Disclaimers”, “Terms of Service”, comprise of a legally binding agreement between “you”, either personally or behalf of a Limited Liability Company, “LTD”, “CORP”,”INC” or any sole proprietorship, or general partnership and AG Global Designs (“We”, “Our “or “Us”) regarding all terms of access and use of our services and website (the “site”). In addition, when using our services, you will be subject to any posted guidelines or rules relevant to such services. Any participation in our services will constitute acceptance of this agreement.

By accessing the AG Global Designs website (the “site”) you accept to these terms and conditions. Do not continue to use AG Global Designs if you disagree to agree to all the terms and conditions stated.

The following terminology applies to these Terms and Condition, Disclaimers, Terms of Service, Privacy Statements, and all Agreements: “Client”, “You”, “Customer”, “Your” refers to you. “We, Our, or “Us” refers to AG Global Designs. “Party”, “Parties” refers to both the client and us.

We may terminate, suspend, or alter access to the “site” immediately, without prior notice or reason. Especially upon a breach of Terms.

The Terms and Conditions may be updated by us without notice. You should regularly take note of any changes we make before placing new orders.

This “site” is controlled and operated by AG Global Designs from BC, Canada.

Unless otherwise stated, AG Global Designs and/or its licensors own the intellectual property rights for all material, copywriting “text”, materials “info”, graphics, designs, and content on the “site”.

You must not:

  • Republish and reuse material from AG Global Designs
  • Sell, rent, or sublicense material from AG Global Designs.
  • Redistribute content from AG Global Designs

License Grant

For providing services, you grant AG Global Designs royalty-free, non-exclusive, worldwide right and license to use and reproduce, display, publicly display, modify, excerpt (partly and entirely). Allowing us to publish and distribute graphics, illustrations, audio, video, text, data, or any content, info, materials, and intellectual property. Including without limitation your logo, trademarks and allowing us to archive and have duplicates of the Client’s content and website. AG Global Designs is not acquiring any rights or interest in or to the client’s content, all of which shall remain exclusively to you.

AG Global Designs grants full ownership of all deliverables of a paid project to the client upon the delivery of a project. However, we retain the right to display the deliverables in portfolios, advertising materials, or use on our “site.”

Hyperlinking to Our Content

Anyone may link to any page on our “site” including publications if the link: (a) is not deceptive; (b) does not falsely imply sponsorship, approval, or endorsement of the linking party and its products and/or services; and (c) fits within the context of the linking party’s site; (d) does not make us look unfavorably.

“We” AG Global Designs at any time hold the right to request the removal of a hyperlink, “link” to our website.

Sponsorships and/or endorsements “links” will only be allowed upon approval of both parties.

This website and the services provided, and all the materials (“info”, “content”,) provided “as is” without warranty of any kind, even if implied or expressed. Unless directly expressed under the refunds section of the Terms of Service. All implied warranties, including, without limitation, implied warranties of merchantability, non-infringement, fitness for a particular purpose, are hereby expressly disclaimed “as is” without warranty of any kind.

AG Global Designs is not accountable for the content or reliability of the linked websites and does not approve any external subject matter, or views conveyed within them.

Limitations of Liability

AG Global Designs under no circumstances will be liable to any person or business entity for any direct, indirect, incidental, consequential, or other damages based on the use of this website, services, or any linked content, including, without restriction, any lost business, profits, or time. Including, without restriction any loss of information or programs.

We do not ensure that the information on this website is correct, we do not warrant its completeness or accuracy; nor do we promise to ensure that the website remains available or that material on the site is kept up to date.

Terms of Service

The Terms of Service is a header that outlines the Terms and Conditions of AG Global Designs services and therefore, all disclaimers and legally binding agreements of the Terms and Conditions on this page still apply.

The client will be provided with the service according to the packages selected. The client’s package will be created to the specification outlined in such package.

Packages on AG Global Designs may be updated, changed, or altered without prior notice. Any discounts or changes to packages will not result in refunds, delivery of additional services, or any compensation in terms of money, time, or refunds on past purchases.

Refunds

If a Client is unsatisfied at any time with our service and deliverables of the project have not been delivered the Client may request a partial refund by completing the Refund Application Form which will be provided to the Client upon request.

AG Global Designs executives and legal will evaluate the reason for the request and if deemed acceptable, a refund of fifty percent (50%) of the entire payment made by the client will be reimbursed. Only fifty percent is refunded due to possible labor costs incurred. Unless both parties can come to an alternative mutual agreement.

Conditions of the Refund Policy:

  • You will not receive a refund if you have confirmed or approved a design. Your consent comprises an implied declaration of contentment.
  • When a refund is issued by AG Global Designs the client shall surrender all rights in relation solely to the work, deliverables, concepts, content, and any media. And use of any refunded work that was done is considered copyright infringement of AG Global Designs.
  • If AG Global Designs works with you for a period longer than five (5) consecutive business days, you will not be valid for a refund.
  • Any discount, special offer, or other deal will not be refunded half of the non-discounted amount. Refunds will be exactly half of what the client paid.
  • If you or the company change any names, undergo changes that make a design useless to you, we cannot issue a refund.
  • Refunds will not be issued for any recurring subscriptions with AG Global Designs.

Revisions

The revision stage of a project consists of a set number of revisions or rounds of revisions stated within the package upon that certain day, month, year of purchase. You are urged to provide as much feedback, instruction, and direction as possible with each submission for revisions.

  • The client can request composition changes to the project immediately upon our submission of a draft.
  • A use of a “round of revision” constitutes a submission of request through any source including email, any text, phone, or our site to change multiple “small” changes or a singular “large” change.
  • A use of a “revision” constitutes a submission of request through any source including email, any text, phone, or our site to change a singular “small” change.
  • The client agrees to allow AG Global Designs to determine what constitutes as a “small” and/or “large” round of revision, and/or revision, without input.
  • Upon delivery of a project and the client’s approval or confirmation. The project will be closed, and the client will be unable to use unused revisions, rounds of revision, or request any changes.

Payment

The client ordering any of the offered services is required to make payment prior to commencement through the payment methods provided by AG Global Designs. Payments will be required to be paid in full before beginning the design process. Unless a mutual agreement is met between both parties.  Upon receiving payment, the client will receive a receipt and all the documentation required to begin the design process.

Project Extent

The client agrees to deliver timely answers, and/or responses to AG Global Designs after getting notice, delivery of any drafts, questions, or whatever is required to continue work on the project that is needed from the client. If the client exceeds ten (10) business days of no contact AG Global Designs will presume completion of the project and deem it completed. The client agrees that any pauses on a project will need to be requested. And lack of confirmation of a pause will result in automatic completion of the project after ten (10) business days of no contact.

Eligibility

The client must agree to all Terms and Conditions, Terms of Service, Disclaimers, Privacy Policy, and all other posted policies on the site. The client must be at least eighteen (18) years of age. And by attempting to purchase or ask for our services you exemplify and justify that you meet these eligibility requirements. If you are purchasing for another entity, you must be authorized to attach that entity to the Terms and Conditions, and all other policies. AG Global Designs has the right to accept or reject your order at the company’s sole discretion without reason.

Website Design

Prohibited content: Client will not knowingly add, modify, include any text, sounds, graphics, animations, and/or videos that might be viewed as illegal or obscene. This include links to other websites that might be illegal or explicit.

Maintenance and Repair: This service does not include maintenance. Client is responsible for maintaining the website once completed. Any further changes, addons, or requests will be charged at a set hourly rate or fixed rate that is determined by AG Global Designs after the project is completed.

Copyright of Website: You the client agree, and fully understand that AG Global Designs may use its own and/or purchase third party licenses to complete the website design, development, backend, and frontend. And you further agree and understand that any Third-Party Assets used to design and develop the Website cannot be transferred to you. You are prohibited from using any of AG Global Design’s and/or its licensors property outside of the content and context of the website. AG Global Designs and licensors retain the right to display the graphics, designs, or any other element of the site in portfolios, advertising materials, or use on our “site.”

Payments: An agreement between both parties can be reached where fifty percent (50%) of the full payment can be made initially and the remaining fifty percent (50%) is made before completion and delivery of the website.

Other: All other Terms and Conditions, Terms of Service, Disclaimers still apply. Including eligibility, project extent, payments, refunds, and revisions.

Delivery: Client is required to get their own domain and then has the option to subscribe to our hosting management services or to find their own provider. We will provide appropriate migration files upon completion of project.
